Welcome to AirScore™ (“AirScore,” “we,” “us,” “our”). By accessing or using the AirScore website, content, or services (collectively, the “Services”), you agree to these Terms of Use (“Terms”). If you do not agree, do not use the Services.

1) Eligibility & Account

You must be capable of forming a binding contract to use the Services. If you create an account or subscribe by email, you are responsible for maintaining the accuracy of your information and the security of your access.

2) Informational Use Only; No Professional Advice

AirScore provides environmental information and data visualizations for educational purposes only. AirScore does not provide medical, environmental, legal, or financial advice, and does not assess or quantify health risk. You are solely responsible for your decisions and use of the information.

3) License & Ownership

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. All content, software, and data models are owned by AirScore or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, publicly display, modify, or create derivative works from the Services without our prior written permission.

4) Acceptable Use

Do not use the Services for unlawful, harmful, or fraudulent activities.
Do not scrape, harvest, or attempt to extract data in bulk without permission.
Do not interfere with or disrupt the integrity or performance of the Services.
Do not misrepresent AirScore’s outputs as certified health or regulatory findings.

5) Third-Party Services & Links

Our Services may link to or rely on third-party services (e.g., Google Maps, analytics providers, data sources). We are not responsible for third-party content, policies, or practices.

6) Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect and use information.

7) Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT DATA WILL BE ACCURATE OR CURRENT.

8) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AIRSCORE OR ITS OWNERS, AFFILIATES, DEVELOPERS, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID TO USE THE SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

You agree to defend, indemnify, and hold harmless AirScore and its affiliates, owners, and contributors from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Services or violation of these Terms.

10) Changes to the Services and Terms

We may modify or discontinue any part of the Services at any time. We may update these Terms from time to time; the “Last updated” date reflects the latest revision. Continued use of the Services after changes constitutes your acceptance of the updated Terms.

11) Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

12) Governing Law; Venue

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict of law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Georgia for the resolution of any disputes arising from or relating to these Terms or the Services.

13) Severability & Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision shall not constitute a waiver.
